Performance Benchmarking of Australian Business Regulation

Commissioned study

The first stage of this study was concluded with the release of the report, Performance Benchmarking of Australian Business Regulation, on 6 March 2007. The report outlines a common framework for benchmarking, measuring and reporting on regulatory burden on business, including a range of feasible quantitative and qualitative performance indicators. It also includes as a second stage a proposed program for the first three years of benchmarking.

On 13 April 2007 COAG considered the Commission’s report and agreed to proceed to the second stage of the project. The COAG Communiqué indicates that COAG has agreed to the Productivity Commission benchmarking compliance costs of regulations in targeted areas. COAG has asked Senior Officials to finalise by the end of May 2007 any variations to the areas of regulation to be benchmarked in the initial three-year program. COAG noted the Commonwealth will fully fund the benchmarking exercise.

In the second stage of the study, the Commission will use the preferred set of indicators developed in Stage 1 of the study to compare jurisdictions' performance. The Commission will also comment on areas where indicators need to be refined and recommend methods for doing this.
